These Terms of Service ("Terms") govern your access to and use of the website anejocateringco.com and any related ordering, meal-plan subscription, and trainer-portal services (collectively, the "Services") operated by Añejo Catering Co. LLC ("Añejo," "we," "us," or "our"), a Florida limited liability company based in Palm Beach County, Florida.

By accessing the Services, placing an order, creating an account, or subscribing to a meal plan, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to place orders or create an account. You are responsible for the accuracy of the information you provide and for all activity under your account. Trainer-portal access is provided via a one-time email "magic link"; keep access to your email secure, as anyone with access to your inbox may be able to sign in.

2. Orders, pickup & delivery

All orders are offers to purchase and are subject to acceptance and availability. We may refuse or cancel any order. Pickup and delivery are currently offered within designated Palm Beach County zones; available zones, delivery fees, order cutoff times, and scheduling windows are shown at checkout and may change.

Food is prepared fresh and is highly perishable. You are responsible for refrigerating items promptly on receipt and for following the storage and reheating guidance on each label (bowls carry an approximate 3-day refrigerated shelf life).

3. Meal-plan subscriptions & auto-renewal

Auto-renewal notice. Meal-plan subscriptions are recurring. Unless you cancel, your subscription automatically renews each billing cycle (e.g., weekly) and your payment method is charged the then-current price until you cancel. You may cancel at any time before the next cycle's cutoff — see the Refund & Cancellation Policy.

When you start a subscription you authorize Añejo and its payment processor to charge your payment method on a recurring basis. We will tell you the price, billing frequency, and order cutoff before you subscribe. Prices may change with advance notice; continued use after a price change constitutes acceptance.

4. Pricing, taxes & payment

Prices are in U.S. dollars and exclude applicable Florida and local sales tax, which is calculated and added at checkout. Payments are processed by our third-party payment processor (Square); we do not store full card numbers. You agree to the payment processor's terms in addition to these Terms.

Where the Services are operating in a pre-launch or test mode, no real payment is taken and no order is fulfilled; any "checkout" is for demonstration only.

5. Food safety, allergens & substitutions

Our food is prepared in a shared kitchen and may contain or come into contact with common allergens including wheat, egg, milk, fish, shellfish, tree nuts, peanuts, soy, and seeds. We cannot guarantee an allergen-free product. If you have a severe allergy, you assume the risk of ordering and should notify us before purchase. Nuts are removable on request and dairy-free substitutions may be available; ingredients and substitutions may vary by batch.

6. Nutrition tool & health disclaimer

Not medical or nutritional advice. The AI macro calculator and any generated meal plans are provided for general informational and educational purposes only. They are estimates, are not personalized medical, dietary, or fitness advice, and are not a substitute for consultation with a qualified physician or registered dietitian. Do not use them to diagnose, treat, or manage any health condition. Consult your healthcare provider before changing your diet, especially if you are pregnant, nursing, or have a medical condition.

7. Trainer portal & revenue share

The trainer portal lets fitness professionals create client records, generate plans, and share them. If you use the portal, you represent that you have the right to enter any client information you provide and that you have obtained any necessary consents. You are responsible for the accuracy and appropriateness of plans you share with clients.

Where a revenue-share program is offered (e.g., a percentage of qualifying subscription revenue attributed to your referral), the applicable terms, rate, and payout conditions will be presented to you separately and form part of these Terms. Revenue share is calculated on net amounts actually received and may be adjusted for refunds, chargebacks, and cancellations.

8. Acceptable use

You agree not to misuse the Services, including by attempting to gain unauthorized access, interfering with operation, scraping or overloading our systems or AI endpoints, reselling the Services without authorization, or using the Services for any unlawful purpose.

9. Intellectual property

The Añejo name, logos, brand elements, recipes as expressed, photography, site content, and software are owned by or licensed to Añejo Catering Co. LLC and are protected by applicable law. We grant you a limited, revocable, non-exclusive license to use the Services for their intended purpose. You may not copy, reproduce, or create derivative works without our written permission.

10. Disclaimers & limitation of liability

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the maximum extent permitted by law, Añejo and its members, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the three (3) months before the claim or one hundred U.S. dollars (US$100). Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. You agree that the state and federal courts located in Palm Beach County, Florida have exclusive jurisdiction over any dispute not subject to an agreed alternative process, and you consent to venue there.

12. Changes & contact

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, by additional notice. Your continued use of the Services after changes take effect constitutes acceptance.
